EAS Entertainment Group Talent Extravaganza
EVENT RULES
1. Time Period. The Talent Extravaganza is scheduled for Sunday, June 26th @ 3:00 PM - 6:00 PM.
2. Eligibility. All event ticket holders will be eligible to attend with proof of ticket purchase.
3. General Conditions. The Talent Extravaganza will be a live, in-person event only. Tickets are available beginning February 1, 2022, on a first come, first serve basis, by logging on to www.easentertainment.com or www.bowiecenter.org. Tickets may be reassigned, but ticket purchases are non-refundable. In the event the Talent Extravaganza and/or an activity is not capable of running as planned, EAS Entertainment Group, in its sole and absolute discretion and without any fault or liability, may modify or cancel the Talent Extravaganza. The Company’s failure to enforce any provision or term of these rules shall not constitute a waiver of that provision or any other provision herein. These conditions apply only to the extent permissible under applicable law.
4. Conference Details/Restrictions. The Talent Extravaganza will take place at the Bowie Center for Performing Arts located at 15200 Annapolis Road, Bowie, MD 20715. Airfare and travel expenses to and from the Talent Extravaganza, if necessary is at the sole expense of the attendee. Hotel and airport options are listed on the website www.easentertainment.com, though attendees traveling from out of town may select any hotel or airport of their choice. EAS Entertainment Group is not responsible for medical needs, purchases needed or engaged in at the Talent Extravaganza location, airport, in transit to and from the airport, on the airplane, or outside of the set Talent Extravaganza program, and/or any necessary refunds of travel expenses, is the sole responsibility of the ticket holder.
5. Limited Liability. The Company is not responsible for any technical failures of any kind including, but not limited to, malfunctions, interruptions, or disconnections in internet, network hardware or software, technical or human error which may occur during the administration of the Talent Extravaganza and is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation and attendance at the Talent Extravaganza.
6. Release. YOU RECOGNIZE AND AGREE THAT BY PURCHASING A TALENT EXTRAVAGANZA TICKET, YOU HEREBY WAIVE, RELEASE AND DISCHARGE EAS ENTERTAINMENT GROUP INCLUDING ALL OF ITS EMPLOYEES, OFFICERS, DIRECTORS, PRINCIPALS, MEMBERS, MANAGERS, AFFILIATED COMPANIES, ATTORNEYS, AGENTS, AND OTHER REPRESENTATIVES, FROM AND AGAINST ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, COSTS, CHARGES, FEES, OBLIGATIONS, EXPENSES, SUITS, OR ACTIONS ARISING OUT OF OR RELATING TO ANY ACTIVITIES IN CONNECTION WITH THE TALENT EXTRAVAGANZA (COLLECTIVELY “ACTIVITIES”). YOU UNDERSTAND, ACKNOWLEDGE AND AGREE THAT ATTENDING THE TALENT EXTRAVAGANZA IS OPTIONAL, AND YOUR PARTICIPATION IN IT, INCLUDING ANY ACTIVITIES, MAY HAVE POTENTIALLY SIGNIFICANT AND INHERENT RISKS AND DANGERS THAT NO AMOUNT OF CARE, CAUTION, INSTRUCTION, OR EXPERTISE CAN ELIMINATE. YOU HEREBY ACKNOWLEDGE AND WILLINGLY, EXPRESSLY AND VOLUNTARILY ASSUME ALL THESE RISKS WHICH MAY RANGE FROM MINOR INJURY TO SEVERE INJURY, EVEN DEATH, AND ANY RESULTING DAMAGES AND EXPENSES.
7. WAIVER OF CLASS ACTION. YOU UNDERSTAND AND AGREE THAT IN THE EVENT OF A DISPUTE BETWEEN YOU AND EAS ENTERTAINMENT GROUP REGARDING ANY ASPECT OF THIS TALENT EXTRAVAGANZA AND ITS ACTIVITIES, YOUR SOLE REMEDY IS IN AN INDIVIDUAL CAPACITY, WAIVING YOUR RIGHT TO LEAD OR PARTICIPATE IN A LAWSUIT INVOLVING OTHER PERSONS, SUCH AS A CLASS ACTION.
8. Use of Likeness. You consent to EAS Entertainment Group using photographs, making audio and video recordings featuring your voice, likeness and image and using them at any time as promotional materials during and after the Talent Extravaganza without any additional permission or authorization from you, and without consideration being paid to you.
9. Privacy. You consent to the disclosure of information as well as any personal information you have provided EAS Entertainment Group regarding your talents that is used to present an award or recognition during the Talent Extravaganza.
10. Disputes. Any dispute or claim between you and the Company arising out of your ticket purchase and/or attendance at the Talent Extravaganza will be settled by binding arbitration in Prince George’s County, Maryland, under the Commercial Arbitration Rules of the American Arbitration Association, by one arbitrator appointed in accordance with said rules. The arbitrator will apply the laws of the state of Maryland, and the arbitration will be conducted in English. At the request and expense of the requesting participant, the documents can be translated to their preferred language, and they may have an interpreter attend any proceedings. The arbitration proceedings will be closed to the public and are confidential. Except as may be required by law, neither party may disclose the existence, content, or results of any arbitration without prior written consent of all participants. The prevailing party, if any, shall be entitled to reimbursement from the other party or parties for its costs and expenses (including reasonable attorneys’ fees) incurred in connection with such arbitration. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. THE PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL TO RESOLVE ANY DISPUTE. This section survives the expiration of the 2022 Talent Extravaganza.
11. Governing Law and Jurisdiction. If a dispute relating to the Talent Extravaganza is submitted to a court, the parties agree to jurisdiction in Prince George’s County, Maryland. This section survives the expiration of the 2022 Talent Extravaganza.
